1. Introduction

These Terms of Service ("Terms") govern your use of the VybeSports website (vybesports.co.za) and related services operated by VybeSports (Pty) Ltd ("VybeSports", "we", "us"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Eligibility

You must be at least 18 years of age, or have the consent of a parent or legal guardian, to create an account or place orders. By using our services you represent that you meet this requirement.

3. Accounts

When you create an account you are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You agree to notify us immediately of any unauthorised use. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Products and Orders

Product descriptions, images, and prices are presented as accurately as possible but we do not warrant that they are error-free. We reserve the right to correct errors and to cancel orders affected by pricing mistakes. An order is accepted only when we send confirmation; until then, no contract exists.

5. Payment and Pricing

All prices are displayed in South African Rand (ZAR) and include VAT where applicable. Payment is due at the time of ordering. We accept the payment methods indicated during checkout. Failure to complete payment may result in order cancellation.

6. Delivery

Delivery times are estimates and not guarantees. We are not liable for delays caused by third-party carriers, customs, or circumstances beyond our control. Risk of loss passes to you upon delivery to the specified address.

7. Returns and Refunds

In accordance with the Consumer Protection Act 68 of 2008 ("CPA"), you may return goods within the applicable cooling-off period where entitled. Defective goods may be returned for repair, replacement, or refund as provided by the CPA. Custom or personalised items may not be eligible for return unless defective.

8. Intellectual Property

All content on this website — including text, graphics, logos, images, and software — is the property of VybeSports or its licensors and is protected by South African copyright and intellectual property law. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. Acceptable Use

You agree not to:

  • Use the services for any unlawful purpose.
  • Attempt to gain unauthorised access to any part of the platform.
  • Interfere with or disrupt the services or servers.
  • Submit false, misleading, or fraudulent information.
  • Use automated tools to scrape or access content without permission.

10. Limitation of Liability

To the maximum extent permitted by South African law, VybeSports shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the services. Our total liability for any claim shall not exceed the amount you paid for the relevant order.

11. Privacy

Your personal information is processed in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 ("POPIA").

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the updated Terms.
